The Department of Homeland Security (DHS) has immigration officers in most jails of major cities of the United States. During the arrest, you will likely be interviewed by a DHS agent, and will be asked about your immigration status. Most of the times you will not even realize that DHS was interviewing you. Immigration authorities can put you into removal proceedings, if there is a basis under the immigration laws to do so.
You have to complete your time in the jail or prison for the crime committed, and then you will be transferred to DHS custody. According to the Federal Laws, a state or a local law enforcement authority can only detain you for 48 hours after the completion of their jail time. This means that immigration officials must take you into custody within two days. If they do not, you should contact your Criminal Defense Attorney, and have a writ of habeas corpus filed with the state court demanding your release.
According to the new Immigration Laws, most applications to United States Citizenship and Immigration Services (USCIS), an agency within DHS, now require security clearances and/or fingerprints as part of the application process. This includes: Applications for Citizenship, Renewal of Green Cards, Employment Authorization Documents, and Status Inquiries.
USCIS is using their complicated computer systems, for the security clearances of applicants, and searching for your criminal convictions from anywhere in the US. Now, when the fingerprints are taken, USCIS get a list of all your arrests and convictions. If you have a conviction, for which according to law, you have to be removed from the country, your application will be denied, and you will be placed in removal proceedings.
Department of Homeland Security (DHS) has a campaign to pick up persons living in the United States who have orders of deportation. You might have a deportation order, but you may not even know that there is one. Also, you may be thinking that the deportation order was entered many years ago, and it’s no longer a problem.
If you were ever in immigration court proceedings, but never returned to the court, it is possible that you may have been ordered deported in your presence. There is a list of persons with prior orders of deportation called national “absconder” list. Immigration authorities with the coordination of local law enforcement authorities have been working together to pick up persons on this list. This can happen anywhere including at the US border, or at a local traffic violation pull over.
When you first appear in a court, the judge will ask you if you have an attorney or would like time to contact and hire one. If you wish to fight your removal case, then you need to hire an attorney, and ask the court for time to get an attorney. The court will issue a temporary suspension to the case, and will let you find a lawyer. If you cannot find an immigration attorney by the date given, the court may begin the detention process without your consent.
Unlike other detainees with the right to an attorney, in immigration court, you are not entitled to have an attorney assigned to you at the government’s expense.
